1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your access to and use of Anotics — including our website at anotics.com, our applications, and all related features and services (collectively, the “Service”). The Service is operated by Anotics Limited (“Anotics,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
You may not use the Service if you are barred from doing so under applicable law, or if your account has previously been suspended or terminated by us.
3. What Anotics Is — and What It Is Not
Anotics is a platform that helps people who perform AI data work (such as data annotation, labeling, transcription, and related tasks) to track their work and earnings, protect their livelihoods, build a portable and independent record of their experience, learn and improve their skills, and connect with a community of peers.
Important clarifications about the nature of the Service:
- Anotics is an independent platform. We are not affiliated with, endorsed by, or partnered with any AI data-work platform (such as, by way of example, third-party annotation or task platforms) unless we expressly state otherwise. References to such platforms are for your reference only.
- You remain in control of, and responsible for, your own work. Anotics provides intelligent assistance — including guideline interpretation, institutional knowledge, similar-case retrieval, and recommendations with transparent reasoning — but you review, edit, and confirm every recommendation. Anotics does not autonomously submit work to any third-party platform on your behalf, and does not sit certification or qualification assessments for you. You are solely responsible for the work you submit on any third-party platform and for complying with those platforms’ own rules and agreements.
- Anotics is not an employer, recruiter, or agent. We do not employ you, guarantee you work, or act on your behalf with any third party.
- Anotics does not provide legal, financial, tax, medical, or professional advice. Any information, tools, templates (such as appeal letters), estimates, or AI-generated content provided through the Service are for general informational purposes only and are not a substitute for advice from a qualified professional.
4. Your Account
To use most features, you must create an account. You agree to:
- Provide accurate, current, and complete information;
- Keep your login credentials confidential and secure;
- Be responsible for all activity that occurs under your account;
- Notify us promptly of any unauthorized use of your account.
You are responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Post, share, or transmit content that is unlawful, harmful, harassing, defamatory, abusive, threatening, hateful, discriminatory, obscene, sexually explicit, or otherwise objectionable;
- Post content that sexualizes, endangers, or exploits minors in any way;
- Harass, bully, threaten, impersonate, or intimidate any person;
- Upload or transmit viruses, malware, or any malicious or harmful code;
- Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems;
- Scrape, harvest, or collect data about other users without authorization;
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure;
- Use the Service to send spam or unsolicited communications;
- Circumvent, disable, or interfere with security or access-control features;
- Use automated means (bots, scrapers) to access the Service except as expressly permitted;
- Misrepresent your identity or affiliation, or post false or misleading information;
- Use the Service to facilitate fraud or any deceptive practice;
- Resell, sublicense, or commercially exploit the Service without our written permission.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section — including removing content, restricting features, and suspending or terminating accounts.
6. User Content
Your content. You may post content to the Service — including profile information, work records, messages, posts, comments, notes, images, and other materials (“User Content”). You retain ownership of your User Content.
License to us. By posting User Content, you grant Anotics a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use your User Content solely as necessary to operate, provide, and improve the Service. For content you share publicly or with other users (such as community posts or messages), this license extends to making that content available to the relevant audience you chose. This license ends when you delete your User Content or your account, except (a) where you have shared content with others who have not deleted it, (b) for backups retained for a limited period, and (c) as required by law.
Your responsibility. You are solely responsible for your User Content and represent that you have the rights necessary to post it and that it does not violate these Terms or any law or third-party right.
Our rights. We are not obligated to monitor User Content, but we may review, moderate, remove, or restrict any User Content that we believe violates these Terms or may harm the Service, other users, or third parties. Moderation decisions are described further in Section 7.
7. Community, Messaging, and Moderation
The Service includes community and communication features (such as community circles, group chats, direct messages, meetings, and similar features). When you use these features:
- You are responsible for how you interact with others;
- You must follow the Acceptable Use rules in Section 5;
- Content posted in public or shared spaces may be visible to other users according to the visibility settings you choose.
Moderation and reporting. We provide tools to report content and users. When content is reported, our moderators review the reported items. For private communications (such as direct messages and private groups), moderators review only the specific content that has been reported, not your other private messages.
Enforcement. Depending on the severity and circumstances, we may issue warnings, hide or remove content, restrict your access to certain features, suspend your account, or terminate it. Some automated safeguards may apply temporary restrictions, which our team can review. We aim to apply enforcement fairly, but we make no guarantee of any particular process, timing, or outcome.
No recording representation. Where we state that a feature (such as meetings) is not recorded by us, that refers to our own systems. We cannot control whether other participants capture or record content through their own means.
8. AI Features
The Service includes features powered by artificial intelligence (such as learning and skill-building tools and assistants). You acknowledge and agree that:
- AI-generated output may be inaccurate, incomplete, or unsuitable for your purposes, and you should not rely on it as professional advice or as a statement of fact;
- AI features provide assistance, recommendations, and reasoning to help you do AI work better. You review, edit, and confirm all output before use. Anotics does not autonomously submit work and does not sit certification or qualification assessments for you. You remain responsible for complying with any third-party platform’s rules — including any rule restricting external assistance on a given task — and for the work you ultimately submit;
- You should independently verify any important information provided by AI features;
- We are not liable for any action you take based on AI-generated output.
We may impose usage limits on AI features (for example, daily limits on free accounts), and we may change these limits at any time.
Anotics does not guarantee that use of its AI tools will result in acceptance, employment, improved ratings, increased earnings, successful appeals, or any particular outcome on any third-party platform.
9. Paid Features and Subscriptions
Some parts of the Service may be offered for a fee (for example, premium or “Pro” features, or paid mentorship). If you purchase a paid feature:
Pricing and billing. Prices, billing cycles, and included features are presented at the time of purchase.
Payment processing. Payments are processed by Paystack and may also be subject to the terms and policies of the relevant payment provider.
Renewals. Subscriptions may renew automatically unless cancelled before the renewal date.
Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that period expires.
Refunds. Except where required by applicable law, subscription fees and other payments are non-refundable. Mandatory consumer rights under applicable law will apply where required.
Taxes. You are responsible for any applicable taxes unless we state otherwise.
Changes to pricing. We may change pricing from time to time. We will provide reasonable notice of any price changes affecting an existing subscription. Changes will not apply retroactively to billing periods already paid for.
If you purchase through a mobile app store (such as the Apple App Store or Google Play), additional terms from that store may apply, and billing may be handled by the store.
10. Mentorship and User-to-User Interactions
Where the Service facilitates connections between users (such as mentorship), Anotics acts only as a platform that helps users connect. We do not vet, endorse, supervise, or guarantee any user, mentor, advice, or interaction. Any arrangement between users — including any payment, advice, or commitment — is solely between those users, at their own risk. We are not a party to and are not responsible for such arrangements.
11. Intellectual Property
Our IP. The Service — including its software, design, text, graphics, logos, the “Anotics” name and brand, and all related intellectual property (excluding User Content) — is owned by Anotics or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service except as permitted by law or with our written consent.
Feedback. If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
12. Third-Party Services and Links
The Service may integrate with or link to third-party services (for example, email delivery, video calling, payment processing, or external websites). We are not responsible for third-party services, their content, or their practices. Your use of them is governed by their own terms and policies.
13. Privacy
Your use of the Service is also governed by our Privacy Policy available at: https://anotics.com/privacy, which explains how we collect, use, and protect your information. By using the Service, you consent to the data practices described there.
14. Account Suspension, Restriction, and Termination
By you. You may stop using the Service and request deletion of your account at any time through the Service.
After deletion is requested, your account enters a 30-day recovery period before permanent deletion. Once this period expires, your account and associated data will be permanently deleted, except where retention is required by law or reasonably necessary for fraud prevention, security, dispute resolution, backups, or other legitimate operational purposes.
By us. We may suspend, restrict, or terminate your access to the Service, in whole or in part, at any time — with or without notice — if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or for any other reason permitted by law. Where practical and lawful, we will try to give you notice.
Effect of termination. On termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections on User Content licenses, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content, estimate, record, or AI output will be accurate or reliable. Any earnings figures, hourly-rate calculations, lost-income estimates, projections, or similar outputs are estimates based on the data available and are not guarantees. You use the Service and rely on its outputs at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- Anotics and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
- Our total aggregate liability for all claims relating to the Service shall not exceed the greater of:
- (a) the total amount paid by you to Anotics during the twelve (12) months preceding the event giving rise to the claim; or
- (b) USD $50.
These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Anotics and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
18. Changes to the Service and to These Terms
Changes to the Service. We may modify, add, or discontinue features of the Service at any time. We are not liable to you for any such change.
Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new “Last updated” date and/or notifying you through the Service). Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria, and you consent to that jurisdiction and venue.
20. General Provisions
- Entire agreement. These Terms, together with the Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Anotics regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. These Terms do not create any third-party beneficiary rights, except as expressly stated.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
- Notices. We may provide notices to you through the Service or by email. Users may send notices or legal communications to support@anotics.com.
